Refund Policy
At innovativewebhouse, we strive to deliver exceptional web development services. This Refund Policy outlines the conditions under which refunds may be issued for services provided from our office at C. La del Manojo de Rosas 94, Madrid, Madrid, Espana, Espana.
Project-Based Refunds: For project-based work, refunds are evaluated on a case-by-case basis according to project milestones and deliverables completed. If a project is cancelled before significant work has commenced, a partial refund of the initial deposit may be issued at our discretion.
Completed Work: Once a milestone has been delivered and accepted, the associated fees are non-refundable. Acceptance is defined as explicit written confirmation from the client or the passage of 7 business days without objection following delivery.
Deposit Policy: An initial deposit of 30-50% (as specified in the project agreement) is required before work begins. Deposits are non-refundable unless the project has not commenced within 14 business days of payment.
Subscription Services: For ongoing services such as hosting, maintenance, or support retainers, refunds are available within the first 14 days of the billing cycle if the service has not been materially used.
Dispute Resolution: If you are dissatisfied with our services, we encourage you to contact us at [email protected] to discuss your concerns. We are committed to resolving disputes fairly and in accordance with applicable consumer protection laws.
Refund Processing: Approved refunds are processed within 10 business days to the original payment method. Processing times may vary depending on your financial institution.
Exceptions: Custom-developed software, licensed third-party assets purchased on behalf of the client, and work completed under a signed Statement of Work are non-refundable.
Terms of Service
These Terms of Service govern the use of services provided by innovativewebhouse, operating from C. La del Manojo de Rosas 94, Madrid, Madrid, Espana, Espana. By engaging our services, you agree to the following terms.
1. Scope of Services: innovativewebhouse provides web development, design, optimization, and related digital services as outlined in individual project agreements or statements of work (SOW). Each SOW constitutes a binding agreement specifying deliverables, timelines, and pricing.
2. Client Obligations: The client agrees to provide timely access to necessary resources, content, feedback, and approvals as required for project completion. Delays in client-provided materials may result in adjusted timelines without liability to innovativewebhouse.
3. Payment Terms: Invoices are payable within 14 days of issuance unless otherwise specified. Late payments may incur a statutory interest rate as permitted under Spanish commercial law. Work may be suspended for accounts overdue by more than 30 days.
4. Intellectual Property: Upon full payment, all intellectual property rights for deliverables specified in the SOW transfer to the client. innovativewebhouse retains ownership of pre-existing code, frameworks, and tools used in development, granting the client a perpetual, non-exclusive license to use them within the delivered project.
5. Confidentiality: Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This obligation survives termination of the agreement for a period of 2 years.
6. Limitation of Liability: innovativewebhouse's total liability under any engagement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We shall not be liable for indirect, consequential, or incidental damages.
7. Warranty: We warrant that services will be performed in a professional and workmanlike manner consistent with industry standards. A 30-day warranty period applies following final delivery, during which we will address any defects in deliverables at no additional cost.
8. Termination: Either party may terminate an agreement with 14 days' written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date.
9. Governing Law: These terms are governed by the laws of Spain. Any disputes shall be resolved through the competent courts of Madrid, Spain.
10. Amendments: innovativewebhouse reserves the right to update these Terms of Service. Material changes will be communicated to active clients via email. Continued use of our services following notification constitutes acceptance of the updated terms.
